Ad Hoc Option

End-to-End Conduct of Employment Tribunal Cases


Benefit from no ongoing costs. Our fees for dealing with Employment Tribunal cases on an ad hoc basis vary depending on the complexity of the case, the number of witnesses, the length of the hearing and whether attendance in person is required.

An example timeline for an Employment Tribunal case:

  • Reviewing ET1 and Finalising ET3: Reviewing ET1, analysing issues of law and fact, taking instructions from client and drafting/ finalising ET3 to include applications for strike-out and/or deposit orders, where appropriate.

  • Document Disclosure and Tribunal Bundle Preparation: Consideration of documents provided by client and other side, consideration of issues of legal privilege, assessing provenance (to include consideration of metadata in electronic files), probative value and relevance generally. Drafting list of documents followed by draft bundle index, consolidating draft bundle, pagination and document production.

  • Witness Statements: Drafting effective and persuasive witness statements to include taking initial draft witness statements, assessing for relevance / evidential relevance in respect of disputed issues of fact and ensuring key documents are cross-referenced and put in evidence. The process also includes considering all issues of law and ensuring compliance with the procedural rules.

  • Tribunal Final Hearing Preparation: Tribunal final hearing preparation by Neathouse Partners to include consideration of all key points, research of key legislation and case law, and preparing cross-examination strategies, questions and submissions.

  • Hearing Representation: Hearing representation (per day) including attendance at telephone or video hearings.

Employment Tribunal Insurance

Employment Tribunal insurance protects your business against all the costs (legal fees, awards & settlements) of defending an employment tribunal claim. The policy includes the cost of obtaining an injunction (or damages) against an ex-employee for their breach of a restrictive covenant.
